USCIS Announces Inflation Adjustment to Premium Processing Fees

USCIS recently announced that premium processing fee rates will be increased to account for inflation. The final rule contains details of the cost analyses to justify the decision. Other filing fees remain the same at this time. The premium processing fee change will go into effect on February 26, 2024. The affected benefit requests with this change are:

  • H-1B / O-1 / E-3 / TN: from $2,500 to $2,805
  • I-140 (Permanent Residency): $2,500 to $2,805

Which Fee Should You Use?

During this transition, your OISS adviser will send you an email to advise you which fee rate to use for your existing sponsorship requests. The determination will be made by considering the request start date, case processing status, and filing timing.

Important Notes:

  • Please wait for your OISS adviser’s instruction email before reaching out with any fee update-related questions. Advisers are focusing on processing as many requests as possible using the current rate. We kindly ask for your patience and request that you refrain from sending additional related inquiries, as it may contribute to delays in their workflow.
  • If you already placed a check request for premium processing with the current rate, please do not cancel or void the check unless otherwise instructed by your OISS adviser.    
  • If you submit a New Sponsorship Request via OISS Connect after this announcement (1/11/24), please use the new fee rate.
  • Please select an overnight service when you create a courier label. This helps OISS to manage the delivery timing of each of the upcoming petition submissions during the transition, and minimizes issues caused by delivery delays that may affect the correctness of the fee rate.
